About Filing360

Is Filing360 a government website?

No. Filing360 is a private facilitation platform. Company registrations, GSTINs and tax registrations are issued only by government authorities such as the Ministry of Corporate Affairs (MCA), GSTN and the Income Tax Department.

What is included in the professional fee vs government fees?

Professional fees cover expert guidance, document drafting and filing assistance. Our prices are exclusive of GST. Government fees, stamp duty, notary and Digital Signature Certificate (DSC) costs are extra and vary by state, authorised capital and entity type. We share the full estimate in writing before you pay.

How long does Private Limited company registration take in India?

With complete documents, most incorporations take about 7–10 days. Name objections, incomplete proofs or MCA queries can extend this. Foreign or NRI directors usually need more time for apostille and notarisation.

What documents are required to register a company?

Typically: PAN and Aadhaar of directors/subscribers, photographs, address proof, registered office proof with owner NOC, and DSC for signing. Exact requirements depend on whether you choose Pvt. Ltd., LLP or OPC and whether directors are residents.

Can I use my home address as the registered office?

Yes. In most cases a residential address can be used if you provide a recent utility bill and a No Objection Certificate from the owner, as required under MCA norms.

Which is better — Private Limited, LLP, or OPC?

Pvt. Ltd. suits startups planning equity funding and ESOPs. LLP suits professional partnerships wanting limited liability with lighter governance. OPC suits a single founder who wants corporate protection with a nominee. We’ll recommend based on your goals on the consultation call.

Do I need GST registration when I incorporate?

Not always on day one. GST is typically required when you cross the turnover threshold, sell online across states, or otherwise fall under mandatory categories. Our ₹99 GST applicability evaluation tells you whether you need it — and GST registration is included in our company incorporation packages.

Do you help after incorporation?

Yes. GST return filing, income tax returns, annual MCA compliance (AOC-4, MGT-7, director KYC) and event-based changes are all handled on the same desk, so you don’t chase multiple vendors.

Company, LLP & OPC registration

Can an LLP be converted into a private limited company later?

Yes. An LLP can be converted into a company under the Companies Act, 2013. The process involves approvals from all partners, fresh MoA and AoA, and filings with the MCA.

Is an LLP cheaper to register than a private limited company?

Registration costs are similar. The real difference is in annual compliance — an LLP below the audit thresholds is cheaper to maintain each year.

Can an NRI register a One Person Company?

Yes. Since April 2021, any Indian citizen — resident or not — can form an OPC. The nominee must also be an Indian citizen.

Can an OPC have more than one director?

Yes. An OPC has one member (owner) but can appoint up to 15 directors.

GST

Can a composition dealer sell on Amazon or Flipkart?

Yes, for supplies of goods within the same state, subject to conditions. Inter-state supplies through marketplaces are not allowed under composition.

What is the due date for CMP-08?

CMP-08 is filed quarterly by the 18th of the month after the quarter ends. GSTR-4 is the annual return, due by 30 April after the financial year.

Can my customers claim input credit on my bill?

No. A composition dealer issues a bill of supply without GST, so buyers can't claim credit — which is why B2B customers often prefer regular suppliers.

What happens if I cross ₹1.5 crore turnover?

You must move to the regular scheme by filing the withdrawal form within 7 days of crossing the limit, and start issuing tax invoices.

Income tax

Which regime applies if I don't choose?

The new regime is the default. You must opt for the old regime when filing your return (or, for business income, by filing the prescribed form before the due date).

Can I claim HRA in the new regime?

No. HRA, LTA, 80C, 80D and home-loan interest on a self-occupied property are not allowed in the new regime.

Is income of ₹12.75 lakh tax-free for salaried employees?

Yes, under the new regime. The ₹75,000 standard deduction brings taxable income to ₹12 lakh, and the rebate makes the tax nil (for resident individuals, excluding special-rate income).

Can I tell my employer one regime and file in the other?

Yes. If you're salaried, the choice you make at filing time is final for that year, even if your employer deducted TDS under the other regime.
